TERMS AND CONDITIONS OF SALE

• All bidders must be registered in order to bid. Bids WILL NOT be accepted from unregistered bidders.
• Purchaser agrees to accept ownership of vehicles/merchandise at the time the auctioneer declares the item sold. Buyer assumes all responsibility and liability for purchased items at that time without exception.
• Purchaser's agreement: PURCHASER agrees to purchase said lot for the price of last bid plus buyer's premium; that upon making settlement that NO stop payment of funds will be honored: and any stop payment order of check or giving a check which is returned marked "insufficient funds" shall be deemed by the parties to be prima facie evidence of Fraud existing at the time the transaction was consummated and shell be construed by the parties as an intent to defraud in order to consummate the transaction.
• Automobiles are offered for sale by Lot Number. The auctioneer will accept bids from bidder's present at the auction, absentee bids by telephone, or absentee bids left in writing in advance of the sale. The auctioneer has the right to place a bid for the consignor up to the reserve amount. The auctioneer will not place any bids on behalf of the consignor above the reserve amount. Consignors have the right to remove or lower any reserve amount at any time prior to or during the sale.
• All vehicles are displayed prior to the auction for buyers to preview and make inspections. All vehicles are sold AS-IS and WHERE-IS. Buyers are buying vehicles based entirely upon their own, or their agents, personal inspections, examinations, and opinion. Capital Auctions makes no guarantee either written or implied as to the originality, or condition of any vehicle offered for sale. The information provided by Capital Auctions should be deemed reliable, but is not guaranteed.
• Upon the auctioneer's acceptance of final bid, and vehicle being awarded to buyer, buyer is responsible to pay the final bid price plus buyer's premium, and any applicable fees and taxes. Non-payment will deem bidder liable for all losses incurred in the resale of vehicle.
• Please be advised that the auction is being video recorded and photographed. Your presence constitutes your consent to Capital Auctions to use your image in any promotional material including but not limited to; Web Site, Published advertising, television and any and all media. This also implies to any guests or family members in attendance with you.

PAYMENT TERMS

• Payment must be all in U.S. Funds.
• CASH/ CERTIFIED FUNDS/ PERSONAL OR COMPANY CHECK, VISA, MC, DISCOVER.
• Personal or company checks must be accompanied by a bank letter of guarantee, or purchased items may be held until funds have been fully credited to Capital Auctions, Inc.
• Payments by Credit Card will be charged a 2% fee.
• All transactions are subject to buyer's fee, title and transfer fees and applicable sales tax.
• PAYMENT IS REQUIREDED WITHIN ONE HOUR OF PURCHASE.
• A 25% deposit is required on the day of the sale to hold purchase.
